During the process of connecting with ASEs to sign authorization cards to form a union of Academic Student Employees (ASEs) at WSU, WSU-CASE/UAW (Coalition of Academic Student Employees, United Automobile, Aerospace and Agricultural Implement Workers of America) has heard some concerns and questions about the rights of international ASEs to sign authorization cards or be involved in efforts to form our union.

Specifically, some ASEs have heard that signing an authorization card or being involved in union efforts may have a negative consequence regarding their visa status, employment opportunities, and other important issues. Another concern has been shared that signing a card would place international ASEs’ names on a list where government agencies or future employers may see that they supported a union.

These statements are not only inconsistent with the law, they have no basis in the experience of tens of thousands of international ASEs who have formed unions throughout the U.S. WSU International Student Services sent out an Immigration Advisory on Friday September 23rd reiterating the facts about international ASE’s rights with regards to forming a union. They state that “union activity is protected in Washington, and there are no implications for international students’ immigration status.” If you would like to read their full advisory you can go to their website via this link.

Here are the facts about rights of international student workers to form unions::

- International students have the legal right to sign an authorization card. In fact, international ASEs hold many of the leadership positions in UAW Academic Worker locals and are active in driving the advocacy agendas of Locals.
国际学生有签署授权卡的合法权利。实际上,国际学生ASE在各自的UAW工会中担任许多领导职务,并积极推进工会组织议程。 - No academic union members have ever reported any complications arising from being both an International ASE and a unionized employee, because they have the legal rights and protections to be involved with their unions. This is why there are no known issues with visas or employment for signing an authorization card or being involved in an academic union among any of the thousands of international ASEs who have signed union cards, publicly supported their union, and held leadership positions. This includes international ASEs involved in unions at the University of Washington, Oregon State University, the University of California, California State University, and dozens of other ASE unions across the country.

PERC (the Washington State agency, Public Employment Relations Commission, that will verify and count ASE union authorization cards) does not release cards to Washington State University or any other government agencies. See WAC 391-25-110 to read the Washington state law that specifies the confidentiality of authorization cards. Because the cards are confidential, WSU Administration, your PI, or anyone else will not have access to information about who signed a card.
